This document governs your use of the public Modyfi Health website (modyfihealth.com). It is separate from — and does not replace — the consent and authorization documents you review and sign as a Modyfi patient, including the Clinical Informed Consent & Provider Policies, the Modyfi Network Data Sharing Authorization, the MAPS Billing Services Consent, and the Modyfi Privacy Practices. Those documents govern your clinical care, billing, and health information. This document governs only your use of the website itself.

Acceptance of Terms

By accessing or using modyfihealth.com (the “Website”), you agree to be bound by these Website Terms of Use (“Terms”). If you do not agree to these Terms, please do not use the Website. These Terms apply to all visitors, including prospective patients, current patients, Modyfi Network providers, and members of the public.

Use of the Website is separate from, and not a substitute for, entering into a clinical relationship with Modyfi Health. If you become a Modyfi patient, your clinical care, billing, and health information are governed by the documents described above, not by these Terms.

Use of the Website

You agree that you will not use the Website to:

  • Violate any applicable local, state, or federal law or regulation.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Interfere with, damage, disable, overburden, or impair the Website or its normal operation.
  • Attempt to gain unauthorized access to any account, system, or network connected to the Website.
  • Introduce viruses, malware, or other code intended to damage or disrupt the Website or its users.
  • Scrape, harvest, or collect information about other users or visitors without their consent.

Modyfi Health reserves the right to restrict or terminate your access to the Website, at its discretion, for conduct that violates these Terms or that Modyfi believes is harmful to the Website, to Modyfi, or to other users.

No Medical Advice

Content on the Website — including blog posts, provider directory listings, and general educational material — is provided for general informational purposes only. It is not medical advice, does not create a provider-patient relationship, and should not be used to diagnose or treat any health condition. Do not rely on Website content in place of professional clinical judgment.

If you are experiencing a medical or mental health emergency, call 911 or go to the nearest emergency room. If you are experiencing a mental health crisis, call or text 988. These crisis resources are also described in the Clinical Informed Consent & Provider Policies.

Scheduling & Intake Forms

The Website may allow you to request a discovery call, join a waitlist, or submit intake information. Submitting a form through the Website does not guarantee acceptance as a patient, availability of a specific provider, or insurance coverage for services. How Modyfi collects, uses, and protects information submitted through the Website is described in the Website Privacy section of the Modyfi Privacy Practices document.

Intellectual Property

The Website, including its text, graphics, logos, and design, is owned by Modyfi Health Inc. or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws. “Modyfi”, “Modyfi Health”, and associated logos are trademarks of Modyfi Health Inc. You may not reproduce, distribute, modify, or create derivative works from Website content without Modyfi’s prior written permission, except as necessary for your own personal, non-commercial use in seeking or receiving care.

Disclaimer of Warranties

The Website is provided on an “as is” and “as available” basis. Modyfi Health makes no warranty that the Website will be uninterrupted, secure, or error-free, and disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by applicable law. Nothing in this section limits or waives any right or protection you have under your Clinical Informed Consent or applicable healthcare law with respect to services actually rendered to you as a patient.

Limitation of Liability

To the maximum extent permitted by applicable law, Modyfi Health will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Website. Because some states do not allow the exclusion or limitation of certain damages, some or all of this limitation may not apply to you.

Changes to These Terms

Modyfi Health may update these Terms from time to time to reflect changes in our services, technology, or legal requirements. The current version will always be posted at modyfihealth.com, with the effective date noted at the top. Material changes will be reflected by updating that date. Your continued use of the Website after changes take effect constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles, and to the extent not preempted by federal law, including HIPAA. Disputes arising under these Terms will first be addressed through good-faith discussion with Modyfi Health before either party pursues formal legal remedies.
